Chapter 13 Discharge Date vs Filing Date: Which One Starts Your FHA Two-Year Clock
If you filed Chapter 13 bankruptcy and someone told you that you have to wait years after your plan ends before you can buy a house, that might not be true, and getting this one date wrong is the single biggest source of confusion we see on this topic.
The Date That Actually Counts
Most confusion around Chapter 13 and FHA eligibility comes down to mixing up three different dates: the filing date, the plan completion date, and the discharge date. Only one of those starts the FHA clock, and it is the discharge date, the date the bankruptcy court formally closes the case.
The Guideline, Word For Word
Straight from HUD 4000.1: "FHA requires the passage of two years since the discharge date of any bankruptcy, including Chapter 13. If the bankruptcy was discharged within two years from the date of case number assignment, the Mortgage must be downgraded to a Refer and manually underwritten. The Mortgagee must obtain the bankruptcy and discharge documents if the credit report does not verify the discharge date."
Three things to pull out of that language. First, the two-year measurement is anchored to discharge, not filing, and not plan completion. Second, if you are still inside that two-year window, the file does not get automatically denied, it gets downgraded to a Refer and manually underwritten. Third, if your credit report does not clearly show the discharge date, your lender is required to go get the actual bankruptcy and discharge documents rather than guessing.
A Common Scenario
A situation that comes up often involves a buyer near Moncks Corner, SC, referred to here as Gianna, who completed a Chapter 13 plan and was given conflicting guidance from multiple sources about her eligibility timeline. Some counted from her filing date. Others counted from when her plan payments ended. When she went and pulled her official discharge order, the actual date on that document did not match any of the assumptions she had been given, and it changed her calculation of when she could move forward.
Why Manual Underwriting Is Not A Dead End
A lot of buyers hear "manually underwritten" and assume that means trouble. It does not mean that. It means a person is reviewing your file in more detail instead of a system doing it automatically. For buyers close to the two-year mark, or with a clean payment history during their plan, manual underwriting is often still a workable path to an FHA approval.
What To Do With This Information
Do not rely on a rule of thumb from a friend, a forum, or even a well-meaning relative. Go get your actual discharge order from the bankruptcy court or your trustee. Confirm the exact date printed on it. Then ask your lender directly whether that date puts you in automated underwriting territory or manual underwriting territory, and what documentation they will need either way.
